These Terms of Use (this "Agreement") govern your use of the Brightcard app ("the App") provided by Fioritmo B.V. ("we", "us"); "Brightcard" is a trademark of Fioritmo B.V. By downloading or using the App, you agree to this Agreement. If you do not agree, do not use the App.

This Agreement is between you and Fioritmo B.V. only, not with Apple. We, not Apple, are solely responsible for the App and its content.

1. License

We grant you a personal, non-transferable, non-exclusive license to use the App on any Apple-branded product that you own or control, as permitted by the App Store Usage Rules in Apple's Media Services Terms and Conditions. You may not copy (except as allowed by the Usage Rules), redistribute, reverse-engineer, or sublicense the App except as permitted by law.

2. What the App does

Brightcard is an on-device wallet for loyalty cards, tickets (events and journeys), vouchers, holdings (including expense reports with receipt attachments), and business cards (which you can keep as separate personas). It stores your data locally on your device, protects access with a device passkey (Face ID / Touch ID / passcode), and does not use accounts or servers. Features that analyze your content — such as reading a receipt to suggest expense fields or detecting a code in a photo — run entirely on your device. You are responsible for your device's security and for keeping your own backups; because your data is stored only on your device, losing or resetting your device (or losing your backup and its key) may permanently lose your data.

If you have a paired Apple Watch, Brightcard Pro can display loyalty cards, tickets and vouchers you explicitly opt in on your Watch, synced directly from your iPhone over Apple's device link with no server involved. Brightcard Pro can also place Home Screen widgets (items you flag, or loyalty cards near a saved location); widgets show only display details and never a scannable code, which stays behind your passkey inside the app.

The App also lets you create encrypted backups and share items with another person via Secure Transfers. A Secure Transfer produces an encrypted file (AES-256-GCM), plus a short transfer code shown only to you that the recipient must enter to open it. The App has no server, so we never receive, route, or store the file or the code — you choose how the file travels (AirDrop, Messages, Mail, a file provider, etc.) and you deliver the code separately. 3. Brightcard Pro — purchases

The App offers Brightcard Pro as a single one-time purchase (a non-consumable in-app purchase). There is no subscription — you pay once and Pro is unlocked permanently for your Apple Account, including on your other devices signed in to the same account. Payment is charged to your Apple Account at confirmation of purchase.

Without Pro, the App is fully usable within free-tier limits: a combined total of 12 items per wallet (loyalty cards, tickets, vouchers, holdings accounts and business cards together), 2 wallets, 1 saved location per card, and 5 balance snapshots per holdings account. Pro removes these limits and unlocks the additional features described in the App.

These limits are keep-all, block-new: if you are ever over a limit, nothing you already saved is hidden, locked, or deleted — only *adding* beyond the limit is blocked until you are back under it or you purchase Pro.

All purchases are processed by Apple. Prices are shown in the App before purchase and may vary by region. Refunds are handled by Apple under Apple's policies; we do not process payments or issue refunds directly. Free features remain available without a purchase, and content you already saved is never removed.

4. Acceptable use

You agree to use the App only for lawful purposes and only for your own cards, tickets, vouchers, holdings, and contacts (or those you are authorized to store). You are responsible for the accuracy and legality of the content you add.

When you use backups or Secure Transfers, you are responsible for choosing whom you send data to and for the channel you use to send it. Because a Secure Transfer's confidentiality depends on the transfer code, you must keep the code separate from the encrypted file and share it only with your intended recipient; anyone who obtains both the file and its code can open the transferred items. You are responsible for only transferring content you are authorized to share, and once you send data to another person or app, its further handling is outside our control.

5. Maintenance and support

We are solely responsible for providing any maintenance and support for the App, as required by law. Apple has no obligation to furnish any maintenance or support for the App. Support requests: support@brightcard.io.

6. Warranty

To the maximum extent permitted by law, the App is provided "as is" without warranty of any kind. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our sole responsibility.

7. Product claims

We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

8. Intellectual property

The App and its content (excluding your data) are owned by us and our licensors and are protected by intellectual property laws. In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. Legal compliance

You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-party terms

You must comply with applicable third-party terms of agreement when using the App (for example, your wireless data plan terms).

11. Apple as third-party beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of it.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the App. Nothing in this Agreement limits liability that cannot be limited under applicable law.

13. Changes

We may update this Agreement. Changes take effect when posted at this URL and, where appropriate, on the next App update. Continued use after changes means you accept them.

14. Governing law

This Agreement is governed by the laws of the Netherlands, without regard to conflict-of-laws rules, except where mandatory local consumer-protection law applies to you.
